Naked Biltong – Terms of Service

Welcome to Naked Biltong! By accessing or using our website, products, and services, you agree to the following Terms of Service ("Terms"). Please read them carefully.

1. Overview

These Terms govern your use of the Naked Biltong website, including all associated services and purchases made via www.nakedbiltong.com (the "Site"), operated by Field To Fork Manufacturing Pty Ltd ("we", "our", or "us").

By placing an order through the Site, you confirm that you are at least 18 years of age, or otherwise have the legal capacity to enter into a binding contract under Australian law, and agree to comply with these Terms.

2. Products and Orders

• All products listed are subject to availability and may be withdrawn at any time before an order is accepted.
• We reserve the right to limit quantities or decline to accept an order — for example, where a product is out of stock, a pricing or listing error has occurred, or we suspect fraud.
• Prices and product descriptions may change at any time, but the price shown at the time you place an order is the price that applies to that order.
• Placing an order is an offer by you to purchase. A contract between you and us is only formed once we send you an order confirmation or dispatch notice. If we're unable to accept or fulfil your order for any reason, we will let you know and refund any payment already made in full.
• By placing an order, you confirm that all details provided are accurate and that you are authorised to use the payment method provided.

3. Payments

• Payment must be made in full at the time of ordering.
• We accept major credit cards and other payment methods shown at checkout.
• Payments are processed through third-party, PCI-DSS-compliant payment providers. We do not directly collect or store your full card details — these are handled by our payment processor in accordance with their own security standards and terms.

4. Shipping & Delivery

• We ship across Australia and provide estimated delivery timeframes at checkout. These are estimates only and are not guaranteed delivery dates.
• Delays caused by third-party couriers or events outside our reasonable control are not our responsibility, though we'll help you track down a delayed order where we can.
• Please make sure your delivery address is correct — we are not liable for orders that are lost or misdelivered as a result of incorrect information you have provided. Where an error is ours, we will put it right at no cost to you.
• Risk in the products passes to you once they are delivered to the address provided. This does not affect any consumer guarantee rights described in Section 5.

5. Returns, Refunds and Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms, or in our Refund Policy, is intended to limit or exclude these rights.

Beyond these guarantees, please refer to our Refund Policy for how to request a return, exchange, or refund (for example, for change-of-mind returns), including any timeframes and conditions that apply.

6. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose.
• Interfere with or disrupt the operation of the Site.
• Copy, distribute, or exploit any content from the Site without our written permission.

7. Intellectual Property

All content on this Site — including text, graphics, logos, and images — is the property of Naked Biltong or its licensors and is protected by Australian intellectual property laws. Unauthorised use is strictly prohibited.

8. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Subject to that, and to the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Site or our products.
• Where we are found liable for a failure to comply with a consumer guarantee that can be limited under the Australian Consumer Law, our liability is limited (at our option) to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
• Outside of the above, our total liability for any claim arising from your use of the Site or our products is limited to the amount you paid for the relevant product.

9. Privacy

Your use of our Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

10. Complaints

If you have a complaint about a product or your order, please contact us first using the details in Section 14 so we can try to resolve it directly. If we can't resolve your complaint between us, you can contact your state or territory consumer affairs office (for example, NSW Fair Trading) or the ACCC for further guidance.

11. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms where that delay or failure results from circumstances beyond our reasonable control, including natural disasters, extreme weather, industrial action, supply chain disruption, or failures of third-party carriers or service providers.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. Any order placed before a change took effect will continue to be governed by the Terms in place at the time of that order.

13. General

• Governing law: These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
• Severability: If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply.
• Entire agreement: These Terms, together with our Refund Policy and Privacy Policy, make up the entire agreement between you and us regarding your use of the Site, and replace any earlier agreements or understandings on that subject.
